Terms & Conditions 

TopCat Worktops - Terms and Conditions

These Terms and Conditions ("Terms") govern the relationship between you ("Customer") and TopCat Worktops ("we," "our," or "us") for the supply and installation of kitchen worktops, including quartz and natural stone worktops. By engaging us for worktop supply and installation, you agree to these Terms. Please read them carefully.

 

1. General Information

TopCat Worktops provides services for the supply, delivery, and installation of quartz, granite, marble, and other natural stone worktops ("Worktops"). These Terms apply to all transactions, including orders, quotations, and installations.

 

2. Quotation & Orders

2.1 Quotation Validity

Quotations provided by TopCat Worktops are valid for 30 days from the date of issue unless stated otherwise. After this period, pricing and availability may be subject to change.

 

2.2 Order Confirmation

An order is considered confirmed when you provide written acceptance of the quotation and make the required deposit payment (where applicable). Any changes to the order after confirmation may result in additional charges. Changes may be made before payment of deposit but this can result in a new quote. 

 

3. Payment Terms

3.1 Deposit

A minimum deposit of 50% is required to confirm your order. The balance of the total cost is due on the day of installation unless otherwise agreed in writing. In the event of the worktop being delivered to the customer and it being of a substandard quality this will be the responsibility of TopCat Worktops to resolve this no further payment will be made until the job can progress. 

 

3.2 Final Payment

Final payment must be made in full before the installation team begins work. Failure to make full payment may result in delays or the cancellation of your installation. 

 

3.3 Methods of Payment

We accept payments via bank transfer. Payment details will be provided upon order confirmation.

 

4. Delivery & Installation

4.1 Delivery

We will deliver your Worktop to the address specified in your order. Delivery times are estimates and may vary based on location and availability of materials. We will notify you of any changes to the delivery schedule. All deliveries are made inside of normal working hours. “Normal working hours” are defined as 9am and 5pm Monday to Friday.

 

4.2 Installation

Installation is scheduled once your Worktop is ready. You must ensure that the installation site is ready and accessible before the scheduled date. This includes having adequate space for delivery and installation, and ensuring that any necessary plumbing or electrical work has been completed. Our Installers are not trained or qualified to undertake electrical or plumbing work and the base for the worktops must be to the standard required to install any worktop prior to delivery. Our team may make suggestions to improve a base for a worktop. All binders or sealants used must be given 48 hours to set. 

 

4.3 Site Preparation

Any preparation work required to install the Worktop, such as the removal of old countertops, is not included unless specifically outlined in the order. We can provide this service for an additional cost upon request.  Our Installers are not trained or qualified to undertake electrical or plumbing work and the base for the worktops must be to the standard required to install any worktop prior to delivery. Our team may make suggestions to improve a base for a worktop

 

4.4 Access & Site Conditions

You must ensure that the installation area is clear, accessible, and free from obstructions. If the installation cannot proceed due to site conditions or access issues, we may need to reschedule or charge additional fees.

 

4.5 Delays

We are not liable for any delays in delivery or installation caused by circumstances outside our control, including but not limited to adverse weather, supply chain disruptions, or unforeseen site conditions.

 

5. Product Quality & Warranty

5.1 Product Warranty

All Worktops supplied by TopCat Worktops come with a manufacturer's warranty, which typically covers defects in material for 15 years and workmanship for 2 weeks. This warranty does not cover damage resulting from misuse, accidents, improper care, or installation errors. Please see the manufacturers T&C’s for the full details of your warranty for your material. 

 

5.2 Inspection

Upon installation, you should inspect the Worktop for any visible defects or damage. If there are any issues, please notify us within 48 hours to resolve the matter.

 

5.3 Natural Variations

Natural stone Worktops (e.g., granite, marble) may have inherent variations in color, texture, and veining. These variations are considered normal, and we cannot guarantee that the finished product will match the sample exactly. We recommend that you review the materials before confirming your order.

 

6. Cancellations & Returns

6.1 Order Cancellation

You may cancel your order within 7 days of placing it, provided that installation has not yet commenced. After this period, cancellations may incur a cancellation fee of any materials that have been ordered and cannot be returned. You may also have to pay any fees incurred for returning materials. 

 

6.2 Returns

We do not accept returns for custom-cut or installed Worktops. If you receive a defective product, we will work with you to arrange for a replacement or repair. Please contact TopCat Worktops to arrange this 

 

7. Customer Responsibilities

7.1 Site Accessibility

You are responsible for ensuring that the installation site is accessible and ready for installation as per the agreed schedule. Failure to do so may result in additional charges for rescheduling or delays.

 

7.2 Damage Prevention

You are responsible for maintaining the Worktop post-installation. While our Worktops are designed to be durable, you should follow the care and maintenance guidelines provided to avoid any damage.

 

7.3 Permits & Approvals

If required, you are responsible for obtaining any necessary permits or approvals for the installation of the Worktop, including building or planning permissions.

 

8. Liability

8.1 Limitation of Liability

TopCat Worktops’ liability is limited to the cost of the Worktop and installation services. We are not liable for any indirect, incidental, or consequential damages arising from the use of our products or services.

 

8.2 Force Majeure

TopCat Worktops will not be held responsible for any failure to perform our obligations under these Terms due to events outside of our reasonable control, such as Acts Of God, war, strikes, or natural disasters.

 

9. Privacy & Data Protection

We are committed to protecting your privacy. Any personal information you provide to us will be handled in accordance with our Privacy Policy, which is available on our website.

 

10. Governing Law & Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales 

 

10.2 Dispute Resolution

Any disputes arising from or in connection with these Terms shall be resolved through the financial ombudsman - https://www.financial-ombudsman.org.uk/ - before escalating to formal legal proceedings.

 

11. Changes to Terms

TopCat Worktops reserves the right to modify these Terms at any time. Any changes will be communicated to you, and the updated Terms will be posted on our website and reasonable notice will be provided.
